为控制和降低职业危害,预防职业病的发生,维护职工健康权益,促进企业安全发展,依据《劳动合同法》、《工会法》、《安全生产法》、《职业病防治法》、《上海市集体合同条例》等法律法规规定,经双方平等协商,签订职业病防治专项集体合同(以下简称专项合同)。专项合同签订后,对企业和职工双方均具有约束力,双方应认真履行。
Inordertocontrolandreduceoccupationalhazards,preventoccupationaldiseases,protectthehealthandtherightsoftheworkers,andpromotethedevelopmentoftheenterprise,theSpecialCollectiveContractOnOccupationalDiseasePrevention(hereinafterreferredtoasContract)isconcludedinaccordancewithLaborContractLawofthePeople'sRepublicofChina,TradeUnionLawofthePeople'sRepublicofChina,ProductionSafetyLawofthePeople'sRepublicofChina,OccupationalDiseasePreventionLawofthePeople'sRepublicofChina,CollectiveAgreementRegulationsofShanghaiMunicipality,andotherrelevantlaws,administrativerulesandregulationsaftertheequalconsultationbybothparties.Beingsignedbybothparties,theenterpriseandtheworkersshallfulfillthetermsoftheContract. 第一章 总则 ChapterOneGeneral
第一条企业职业病防治工作坚持预防为主、防治结合的方针,建立用人单位负责、行政机关监管、行业自律、职工参与和社会监督的机制,实行分类管理、综合治理。
Article1:Thepreventionofoccupationaldiseaseshallfollowtheguidelineofpreventionfirstandprevention&treatmentcombination.Themechanismshallbeestablishedwhereoccupationaldiseasepreventionshallberesponsiblebytheemployer,beregulatedbyadministrativeorgan,beself-regulatedbyindustry,beparticipatedbytheworkers,andbesupervisedbythesociety,andstandtocategorizedmanagementandcomprehensivetreatment.
第二条企业方是职业病防治工作的责任主体。要认真贯彻国家有关职业病防治的法律、法规,建立健全职业病防治工作制度,不断改善生产条件和劳动环境。

第四条企业建立职业病防治工作领导机构,由任组长,成员为
。领导小组负责制定职业病防治工作规划、年度计划,做到机构落实、责任落实、人员落实、经费落实。企业每年应向职代会(职工大会)报告职业卫生情况以及专项合同履行情况,接受职工的监督。
Article4:Theenterpriseestablishesagoverningbodyfortheoccupationaldiseasepreventionheadedby***.Thebodymemberscomefrom***.Thegoverningbodyshallworkoutlongtermroadmapandannualplanfortheoccupationaldiseaseprevention,andmakesurethattherearespecificorganizationsandpersonnelwhowilltakeresponsibilityfortheoccupationaldiseaseprevention,andrelevantbudget.TheenterpriseshallreporttheoccupationalhealthissuesandtheimplementationsoftheContracttotheEmployeeRepresentativeCongress(orWorkersCongress),andacceptthesupervisionofworkers.
第五条企业支持工会按照全总劳动保护监督检查三个《条例》实施群众监督,并提供必要的活动经费。工会定期组织职工代表开展巡查活动。
Article5:TheenterpriseshallsupporttradeuniontoimplementsupervisioninaccordancewiththeRegulationonLaborProtectionInspectorsofTradeUnion,RegulationsonLaborProtectionSupervisionandInspectionCommitteeofGrassrootsTradeUnion,andRegulationonLaborProtectionInspectorsofTradeUnionTeam,andprovidenecessaryactivityfees.Tradeunionorganizesrepresentativesoftheworkerstocarryoutinspectionsregularly.

第九条企业应当按照《关于印发上海市用人单位职业病危害告知与警示工作规范(试行)的通知》(沪安监管职安〔2011〕212号)规定,以合同告知、培训告知、公告/个人告知等形式,将工作场所职业危害、防护措施及相关待遇如实告知职工。并应当在有可能产生职业危害及必要的作业岗位、设备及化学品等材料的产品包装的醒目位置,设置相应的警示标识和中文警示说明。警示说明的具体内容参见《关于印发上海市用人单位职业病危害告知与警示工作规范(试行)的通知》。
Article9:Theenterpriseisrequiredtoinformtheworkersofthepotentialoccupationaldiseaseinductivefactors,theoccupationaldiseasepreventionmeasures,andremunerationsamongotherrelatedinformationbythewayofcontract,training,postorpersonalinformaccordingtothe"NoticeofinformandalertfortheoccupationalhazardsbyemployersinShanghai(Trial)"(HuAnJianGuanZhiAn[2011]No.212)ItisrequiredtopostconspicuouswarningmarksandwarningmessagesinChineseattheworkplace,aswellasontheequipmentsandthepackageofchemical,whichmaycauseoccupationalhazards.Thedetailsofthewarningmessagerefertothe"NoticeofinformandalertfortheoccupationalhazardsbyemployersinShanghai(Trial)".
第十条企业应当定期对工作场所进行职业危害因素检测、评价,建立企业职业卫生档案,并定期向所在区县以上卫生行政部门及安监部门报告职业病危害防治方案及实施情况。

Article11:Theenterpriseshouldprovidetheregularoccupationalhealthtrainingfortheworkers,seriouslyimplementthe"three-level-training1"systemtohelptheworkerstomasterthebasicknowledgeonoccupationaldiseasepreventionandenhancetheircapabilitiesonthepreventionofoccupationalhazardsandemergencyresponses.Theenterpriseisprohibitedfromassigningtheworkerstotheoccupational-disease-inductiveoperationbeforetakingoccupationalhealthtraining.第十二条企业应当对从事接触职业危害的职工进行上岗前、在岗期间和离岗前以及应急职业健康检查,并建立职工职业健康监护档案,承担职业健康检查费用,并将健康检查结果如实告知职工。

第十三条企业应当对从事接触尘毒等有害作业的职工,按不低于国家和本市规定的补贴标准发放岗位津贴。
Article13:Theenterpriseshouldpayappropriatepostallowancewhichisnotlessthantheprescribedstate&municipalitysubsidiesstandardtotheworkersengagedintheoccupational-disease-inductiveoperation,suchasexposedinthedust&poisonenvironment.
第十四条企业应当根据不同作业工种和作业环境按时为职工提供符合国家标准的个人防护用品,并指导、督促其正常使用。
Article14:Theenterpriseshouldprovideeachworkerwiththeoccupationalpreventionarticles,whichshouldcomplywiththestatestandards,basedondifferenttypesofjobsandtheworkingenvironment,andgivethemtheguidanceandsupervisiononhowtousetheoccupational preventionarticlesintherightway.
第十五条企业应当依法参加工伤保险,并按时足额为职工缴纳工伤保险费。
Article15:Theenterpriseshouldparticipateintheinjuryinsuranceforthejob-relatedinjury,andmakethefullpaymentoftheinjuryinsuranceforthejob-relatedinjurytimely.
第十六条企业发生职业危害事故,应依法报安监、卫生、工会等部门。工会依法参加事故调查,提出处理意见并要求追究有关人员的责任。
Article16:Theenterpriseshouldreporttheoccupational-disease-inductiveaccidentstotheadministrationofworksafety,healthydepartment,andtradeunion.Tradeunionshouldparticipateintheaccidentinvestigation,putforwardopinions,andrequestrelevantpersonneltotakeresponsibilities.第十七条企业发现疑似职业病职工,应当及时安排诊断。对确诊患职业病的职工,应当及时给予治疗,并按国家和本市工伤保险政策规定为其办理工伤认定和劳动能力鉴定手续。疑似职业病病人在诊断、医学观察期间的费用由企业承担。
Article17:Theenterpriseisrequiredtoarrangediagnosisfortheworkerssuspectedsufferingfromtheoccupationaldisease.Theworkersdiagnosedwiththeoccupationaldiseasesshouldbegivenprompttreatment,andbegrantedjob-relatedinjuriesandworkabilitiesevaluationsinaccordancewiththestateandmunicipalityregulations.Theenterpriseshouldbearthecostofthediagnosisandmedicaltreatmentofthepatientconcerned. 第三章工会与职工权利义务 ChapterThreeTradeUnionandworkersrightsandobligations
第十八条企业工会有权监督企业严格遵守国家有关职业病防治法律法规,防止和纠正侵犯职工合法健康权益的行为;参与企业制定和修改职业卫生规章制度,对企业的职业病防治工作提出意见和建议;支持企业加强职业安全卫生管理,协助企业加强职业卫生宣传教育,组织职工开展各种防治职业病的活动,不断提高职工的自我保护意识和自我防范能力。
Article18:Tradeunionshouldberesponsibleforthesupervisionoftheenterpriseinabidingthestate'soccupationaldiseasepreventionlawsandregulations,preventandrectifytheviolationsofworkers'legitimaterightsandinterestsofthehealth,participateinestablishing&modifyingtheenterprise'soccupationalhealthregulations,putforwardcomments&advicesonoccupationaldiseaseprevention,supportenterprisetostrengthenoccupationalsafetyandhealthmanagement,assistenterprisetostrengthenoccupationalhealtheducation,organizeworkerstocarryoutactivitiesinpreventingoccupationaldiseases,constantlyimprovetheself-protectionawarenessandself-protectioncapabilitiesofworkers.
第十九条工会依法对企业开展涉及职业危害的新建、改建、扩建建设项目和技术改造、技术引进项目的劳动条件和安全卫生设施与主体工程同时设计、同时施工、同时投产使用进行监督。
Article19:Tradeunionshall,inaccordancewiththelaws,seetoitthattheworkingconditionsandoccupationalsafetyandhealthfacilitiesforenterprisesunderconstructionorexpansionandfortechnologicaltransformationprojectsaredesigned,builtandputintooperationsimultaneouslywiththemainpartsofprojects.第二十条工会坚持“预防为主、群防群治”的方针,通过开展群众性的“安康杯”竞赛、“安全生产月”、“职业病防治周”、创建安全生产“1000班组”等活动,教育职工严格遵守企业的各项职业卫生规章制度和操作规程,组织职工接受职业卫生培训,不断提高职工的职业卫生技术素质和自我防护意识。
Article20:Tradeunionshallorganizeworkerstoparticipateinpreventingoccupationaldiseasebycarryingoutactivitiessuchas"SafetyandHealthCup","SafetyProductionMonth","Occupational-Disease-PreventionWeek",andsafetyproductionof"10002group",educateworkerstostrictlycompliancewiththerulesandregulationsoftheoccupationalhealth&operationalprocedures,organizeworkerstoreceiveoccupationalhealthtraining,andconstantlyimprovetheoccupationalhealthandself-protectionawarenessofworkers. 第二十一条工会有权纠正违章指挥、强令工人冒险作业和没有职业病防护措施作业行为;发现明显职业危害时,工会有权提出改正意见;发现危及职工生命安全的情况时,工会有权向企业建议组织职工撤离危险场所。
Article21:Tradeunionshallhavetherighttorectifythefollowingactivities,suchasthecommandscontrarytoestablishedrules,compellingtheworkerstooperateunderunsafeconditionsandwithoutoccupationaldiseaseprevention.Whenoccupationalhazardsarefoundinthecourseofproduction,tradeunionshallhavetherighttoputforwardproposalsforasolution.Wheretheverylivesoftheworkersarefoundtobeindanger,tradeunionshallhavetherighttomakeaproposaltotheenterprisethatawithdrawaloftheworkersandfromthedangeroussitebeorganized.第二十二条企业职工有权了解其岗位存在的危险和职业病危害因素、采取的防护措施及事故应急抢救措施,有权对本单位的劳动安全卫生工作提出意见和建议,并负有认真遵守企业职业卫生规章制度和执行职业卫生操作规程的责任和义务。
Article22:Theworkersareentitledtothefollowingrightssuchasbeinformedoftheactualoccupationaldiseaseinductivefactors,theirharmfuleffectandnecessaryoccupationaldiseasepreventionmeasures&emergencytreatmentmeasures,bringingforwardcommentsandsuggestionswithregardonthesafetyandhealthworkintheenterprise.Theworkersshalltakeresponsibilitiesandobligationstocomplywithoccupationalhealthregulationsandoccupationalhealthpracticeproceduresintheenterprise.
第二十三条职工在岗位发现直接危及人身安全健康的紧急情况时,有权停止作业或者在采取可能的应急措施后撤离作业场所,并及时向上级报告;有权拒绝管理人员的违章指挥;对危及职工安全健康的行为,有权提出批评、检举和控告,企业不得因此对其刁难或打击报复、不得因此降低职工工资、福利待遇或解除劳动合同。
Article23:Whereemergencyoccursandtheworkersareindangeronthejob,theworkersshallhavetherighttostopworkorleavetheworkplaceafterundertakingpossiblecontingencymeasures,andpromptlyreporttotheup-leverorganization.Theworkershavetherighttodenytheillegalordersandcommandscontrarytotheestablishedrules,criticize,impeachandaccusethepracticesthatharmtheirsafety&health.Theenterpriseshallnotrevengeworkersandtherebyreducetheirwagesandbenefits,orterminatelaborcontracts.
第二十四条职工应当学习和接受职业卫生教育培训,掌握本职工作所需的安全卫生生产知识,提高安全生产技能,遵守操作规程,增加事故预防和应急处理能力。
Article24:Workersshalllearnandaccepttheoccupationalhealthtraining,tomasterthesafetyproductionknowledge,improvethesafetyproductionskills,abidebytheoperationprocedures,andincreaseaccidentprevention&emergencyresponsecapabilities.
第二十五条职工在生产过程中,应当严格执行企业职业卫生规章制度和操作规程,听从指挥,服从管理,正确佩戴和使用劳动保护用品。
Article25:Intheprocessofproduction,theworkersshouldstrictlyimplementtheoccupationalhealthregulationsandoperationalrules,followthemanagementorders,andproperlywearanduseoccupationalpreventionarticles. 第四章附则 ChapterfourSupplementaryProvisions
第二十六条由企业方代表和工会方代表组成职业卫生专项集体合同履行检查组,每季度对专项合同履行情况进行一次检查,在检查中发现问题,企业方应及时整改,整改情况以书面形式提交双方首席代表。拒不整改的,提请相关行政部门处理。
Article26:TheperformanceoftheContractshallbeinspectedquarterlybytheteamcomposedofrepresentativesfromboththeenterpriseandtradeunion.Theproblemsfoundintheinspectionshallbepromptlyrectifiedbytheenterprise.Therectificationshallbesubmittedtothechiefrepresentativesofthetwopartiesinthewrittenform.Iftheenterpriserefusestorectifytheproblems,theissuewillbehandledbyrelevantadministration.第二十七条经企业与职工双方代表协商一致的《职业病防治专项集体合同》草案,应提交职工代表大会或全体职工讨论通过,并经双方首席代表签字后于10日内报送人力资源和社会保障部门审查,人力资源和社会保障部门15天内无异议的,专项合同即行生效。专项合同有效期年。
Article27:ThisContract(Draft)shallbeadoptedbytheWorkers'Congressoralltheworkers,andsignedbychiefrepresentativesforcollectivenegotiationofbothpartiesforsignatureandconfirmation,andthensubmittedtothehumanrecourse&socialsecurityadministrationdepartmentwithintendays.ThisContractshallgointoeffect,providedthatitisnotrejectedbythehumanrecourse&socialsecurityadministrationdepartmentwithinfifteendaysofitssubmission.ThetermsofthisContractshallbevalidforyears. 第二十八条专项合同未尽事宜由双方协商解决,协商达成一致的书面意见经相关法定程序通过后,可作为专项合同的附件一并执行。
Article28:AnyothermattersbeyondthescopeofthisContractshallberesolvedbynegotiation.TheagreementachievedbybothenterpriseandworkersshallbetheannexoftheContract,aftertheadoptionbytherelevantstatutoryprocedures.企业(章):
